Hi, Karen. Thanks for the question, and congratulations on your new venture!
An employment contract certainly sounds like a good next step to define the relationship between your LLC and the pre-school. We have a great article that provides insight into employment contracts and also provides templates for use either by a W2 employee or – in your case – a 1099 contract employee. Your LLC would be used in the employment contract instead of your name. You can read more about employment contracts and check out the templates here: https://fitsmallbusiness.com/employment-contract-template/
Given the special nature of your work and the specific risks you want to address related to working in a classroom with children, you may want to add an extra section to spell out these concerns. You’ll should also be very specific in your job description to make sure that your role and responsibilities are specifically spelled out.
However, if you decide that you want something more robust to address these concerns, there are a number of services online that you can use. One that we consistently recommend is Rocket Lawyer, which you can check out here: https://fitsmallbusiness.com/goto/rocket-lawyer-biz-wiz/
Rocket Lawyer has sample forms and other resources to not only help you structure your business but also help with projects like this contract – just check out their “Service Contracts” section for businesses. You can work with a licensed attorney to structure exactly what you need.
Hope this helps. Best of luck with your new project!
