Can you obtain a license with a DUI conviction?
I have received 2 convictions within the last 10 years. I have not been in any legal trouble for the last 4 years and have remained employed and sober through out. Is this going to stop me from obtaining a license in Virginia? I already have an HPDS 12 clearance and have passed a Federal Background check for my current employment and have disclosed all of this to them. Thank you.
Thank you so much for your question! Virginia imposes a series of requirements on real estate license applicants, including pre-licensing courses and fingerprinting. According to the Virginia Administrative Code, as part of fingerprinting, applicants must also disclose:
“…a. All misdemeanor convictions involving moral turpitude, sexual offense, drug distribution or physical injury within five years of the date of the application; and
b. All felony convictions during his lifetime…”
For this reason, the answer to your question depends on the nature of your past convictions and will be based on a determination by the state’s licensing board in accordance with § 54.1-204 of the Code of Virginia.
