its a part time $30 per hour, 20 hours a week job. (restaurant )

the job description is to create a proper marketing plan, operation plan, P & L organization, hiring and training.
each day 5 hours of part time work when he leaves his main job and come here from 4pm 9pm.

This is a great question. Hiring contract workers vs employees requires documention of the contracted work and requirements. I’ll attach articles with templates below. However, while the work you’re describing could well be done by a contractor, monitoring that contractor’s hours and when and how they do their job will get you in hot water with the department of labor.
It’s best to pay a contractor for work completed (not hours), and to NOT monitor those hours at all. The IRS is very strict about hiring a person to work as an employee while paying them using a 1099.
