Disclosure – Relationship between Mortgage Originator & Realtor
Does a mortgage originator who is married to a Realtor have to disclose the relationship to all parties involved in a transaction?
I represented a Seller who received an offer and pre-approval letter from a Buyer that was accepted. As part of the process, it was learned that the Buyer’s Realtor and Mortgage Originator are husband and wife.
What if any disclosure is required and is there any violation?
Hi – You should consult your local NAR (National Association of Realtors) if you feel there might be an ethics issue. Another choice might be to chat with a real estate lawyer to talk about the situation and get good advice for your state. Different states have different requirements and rights for the seller.
