Do we need to be paying the Oregon sick pay along with the federal?
We have employees that work government contracts and we use the federal wage determination hourly rate and a fringe benefit rate. The fringe benefits include sick pay. Do we need to be paying the Oregon sick pay along with the federal?
Government contracts often override the local (state) labor laws. What I would check is to be sure your employees (under contract) are provided at least the state minimum paid sick leave. If not, you may want to talk with your labor law attorney to revise the contract to match the state minimum in Oregon.
To answer your question specifically, you don’t have to pay the government contract (federal) sick leave and Oregon sick leave on top of that. You just need to make sure the contract provides no less paid sick leave than what Oregon requires.
As long as the contract provides your employees at least the state minimum days of paid sick leave you should be good to go.
