Most listing agreements are bilateral contracts, which means you and your broker must “perform” – meet certain responsibilities under the contract. Your broker’s responsibilities and cancellation terms are likely included in your listing contract, so start by looking at the acceptable grounds for cancellation.
If you are ready to be released from the contract send a request to the agent – in writing – describing the grounds for cancellation. In this case, it sounds like the agent may have failed to sell the home within a specific period of time, has failed to adequately market the home, has not been communicating with you, etc. Also remember that the contract is between you and the broker, not you and the agent. For that reason, you may also request to be moved to another agent.
