If an employee request an EAP is it mandatory for the company to provide assistance to the employee?
Thanks for your question. Our understanding is that an EAP is a voluntary benefit that some companies choose to provide to employees. If your company doesn’t currently provide EAPs and one is requested, it’s up to you whether you want to offer that to your employees. However, like most benefits, you probably need to offer EAPs universally – if you already offer them, then they need to be made available to all eligible employees who want to take advantage.
