My landlord/ step mother has not served me with any written notice
My father passed away in June, my wife and I moved in with my father and step mother in August 2018. No rent, no lease. After my father passed away, she abruptly moved out and a short time later mentioned selling the house. No eviction notice, no papers served- shows up thirty days (according to her) later expecting us to be gone! What are my rights as far as time to vacate? And isn’t she required to serve us written notice?
Hi Hope, this is going to depend on which state you live in as landlord-tenant laws typically are state (and sometimes municipality) specific. Also, it is important to know what the law says regarding an owner-occupied tenancy in a single family residence. You’re likely considered a “tenant-at-will’ or month-to-month tenant since there was no lease, in spite of not paying rent. But I will have to defer to what your state-specific laws say. You soulh be able to find your state’s landlord-tenant laws onlince. If it is vague you can see if there is a legal aid program in your area and/or check with someone in housing court to see if they can direct you. Best wishes.
