Private Business Sale – FedEx Routes
I’m buying FEDEX line haul routes from another contractor. Is it legal for me to ask the ages of the drivers that will be included/part of the deal? Also, I live in CA if that makes a difference.
Sorry it’s taken us so long to get back to you. We’re not licensed attorneys, but what I will suggest is that it’s never a good idea to focus on protected class information such as age, gender or sexual orientation when asking about employees. What you can ask is whether the driver’s are licensed (you can ask to see the licenses, which would then tell you their ages) and whether they’re up to date on medical exams. You can also check their driving records. You might not get caught asking about their ages (especially if it’s a small company you’re buying) but it’s risky as it could fall under ‘discrimination’ if you chose not to do the deal based on the employee’s ages.
