Very informative. Do you believe these fees are still allowable for companies which offer mortgage lending and real estate services? How would potential conflict of interest issues be avoided? Would any additional disclosures be required?

Our article covered referral fees for licensed real estate agents/brokers only, and I do not believe they are allowable for those outside of that industry. Feel free to check your local state real estate commission to double check this if you wish, but I assume if referral fees are not allowable to private citizens who make referrals, they are likely not open to other industries as well.
