With a like kind exchange and new construction, can the lot be owned by us personally or would it need to be owned by our LLC?
That’s a question for your attorney. The rule is it can’t be for your own personal use. If you already own the lot that may be an issue, since you’re not buying real estate, you’d be improving it. I’m not sure how that would impact a 1031E. I’m not clear if you already own the land, or you’re looking at a new piece of land to do ground-up construction.
